1. Acceptance of Terms

These Terms form a binding agreement between you and Dramalize. ("Dramalize," "we," or "us"). If you do not agree, do not use the Service. We may update these Terms periodically; continued use after changes means you accept the updated terms.

2. Eligibility

You must be legally permitted to use the Service in your country or region. If you are a minor, you may only use the Service with the consent of a parent or legal guardian.

3. Accounts & Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately at [email protected] if you believe your account has been compromised.

4. Purchases & Subscriptions

Subscription required for core features: Dramalize is free to download and explore, but video generation requires an active, paid subscription. Subscriptions include a recurring credit allowance that is consumed when generating videos.

Auto-renewable subscriptions: Dramalize offers auto-renewable subscription plans (e.g., weekly or annual). When you subscribe:

Payment is charged to your Apple App Store at confirmation of purchase.
Your subscription automatically renews at the end of each billing period (e.g., every week or year, depending on the plan you selected) unless you cancel at least 24 hours before the end of the current period.
Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate of your selected plan.
You can manage or cancel your subscription at any time through your device's App Store account settings.

Credits: Subscriptions include credits that reset each billing cycle. Unused credits do not carry over to the next billing period unless explicitly stated. Credits consumed for video generation are non-refundable. Additional credit purchases are available only while you have an active subscription and are non-transferable and non-refundable except where required by law.

Refunds: All purchases are processed by the Apple App Store and are subject to their respective refund policies. Unless required by applicable law, payments are non-refundable.

Pricing: Current subscription pricing is displayed in the app at the time of purchase. Prices may vary by region and are subject to change. Any price changes will take effect at the start of your next billing period following notice.

By subscribing, you also agree to our Privacy Policy and these Terms of Service.

5. Creator Content

You retain ownership of the videos and prompts you generate. By using Dramalize, you grant us a non-exclusive, worldwide license to host, process, and display your content solely to operate and improve the Service. You are responsible for ensuring that your prompts and outputs comply with applicable laws and do not infringe third-party rights.

6. Content Responsibility

You are solely responsible for the content you generate using Dramalize. You agree not to generate content that violates applicable laws, intellectual property rights, or platform policies.

7. Promotional Use

You grant Dramalize permission to feature your generated content, username, and likeness for the limited purpose of showcasing or promoting the Service. You may opt out of future promotional use by contacting us at [email protected].

8. Acceptable Use

You agree not to misuse the Service, including by:

Attempting to reverse engineer, interfere with, or disrupt the Service.
Generating content that is unlawful, hateful, defamatory, or violates intellectual property rights.
Uploading malicious code or automated scripts intended to scrape or overload our infrastructure.
Creating realistic depictions of real individuals with the intention to deceive, or defraud.
Generating sexually explicit, exploitative, or abusive content involving minors.
Producing non-consensual intimate or sexual imagery of any real person.
Using generated content for phishing, scams, social engineering, or any form of financial fraud.
Attempting to bypass, circumvent, or disable any content moderation, safety filters, or usage restrictions built into the Service.
Sharing, reselling, or sublicensing your account or access to the Service to third parties.

We reserve the right to review generated content and to remove or restrict access to any content that violates these guidelines, at our sole discretion.

9. Intellectual Property

The Service, including our AI models, trademarks, branding, and platform design, is owned by Dramalize or its licensors. Except for the rights expressly granted to you, we reserve all rights in the Service.

10. Termination

We may suspend or terminate your access at any time if we believe you have violated these Terms or present a risk to the Service. You may stop using Dramalize at any time by deleting your account or uninstalling the app.

11. Disclaimers

The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

12. AI-Generated Content Disclaimer

Dramalize provides AI-generated video content based on user input. Due to the nature of artificial intelligence, outputs may be inaccurate, unexpected, incomplete, or fail to generate. We do not guarantee any specific result or outcome.

12a. Third-Party AI Services & Data Sharing

To generate video content, Dramalize sends your text prompts and related generation settings to third-party AI service providers, including OpenAI, Inc. These providers process your data to fulfill your video generation requests. By using the Service, you acknowledge and consent to this data sharing. 13. Limitation of Liability

To the maximum extent permitted by law, Dramalize will not be liable for any indirect, incidental, or consequential damages, nor for any loss of profits or data, arising out of or in connection with your use of the Service.
